They do look nice, but I'm afraid you can't release them, as they are purchased models and IIRC there's a law about that (I'd need someone more expert on the subject to enlight us). |

Basically any third party image/logo/trademark can be subject to royalty issues. Snowleo released a "Coca Cola" machine quite a while back which basically falls into this realm. Also, pictures up in public places (where I used the skins from) are normally free for non-commercial use (ie: Making money from it). Otherwise, all posters, banners, etc would also need to be pulled down. The owners of the arcade logos in question could seek royalties, or just force me to remove the downloads. I purchased the base model which is not a patented model. Purchasing a blank canvas has no weight on releasing said model. 3d modeller allows the non commercial release of his arcade base. |

He was indeed talking about the fact that you used a purchased model. The problem with this case is that z2fs are nothing more than an archive file like zips and rars, so it's quite easy for anyone to open your file and simply take the model, attaining it without paying it. In terms of 3d design, "non commercial releases" often means either : a) You use the file in a certain form of visual art ( like a poster or video ) and you release said art, but not the actual model b) You use it in your game, but with enough security measures so nobody can attain the model ( for instance, converting it to a specific file format only you and your game can read ) Patented is something you really have to forget, patents are used for completely different things. They aren't used that often for things like written work ( code ) or art like 3d models. There's really one basic universal rule when it comes to art/written work, and that's this :
This is how it works in the majority of the world, so you could call it a kind of universal law ( but to be safe, no, there are no "real" universal laws about this ). The best and safest option here (aka, the thing you really should do ), is simply contact the owner of the model and explain the situation clearly; explaining that there is a risk someone can attain his model without paying. This way, you are absolutely sure that his rights are still protected; which is something you as a buyer are responsible for. So all in all, it's a little bit more complex than you state it here, I'd just contact the owner of the file and ask him about it, it's the safest and most respectful option. ![]() However, this is only based upon the knowledge I have on this, we didn't go extremely in depth about 3d art in our classes. It's all probably a lot more complex than I explained it here, but it's the gist ensures you'll always do the right thing

I spoke a bit with a TurboSquid rep (as they do not allow direct artist contact). He stated that the problem(if any) would NOT be with the model, but with the skins I have created. Again, this is basically like any other download someone makes that contains an intellectual property (such as Coca Cola, Toyota, etc). Should they want to, the companies can file a cease and desist from using their IPs. In a case like a modding community, most large companies do not bother pursuing "small fish". It's a bit different than putting it out there for GTA, Skyrim, etc. A game that's not an "online" massive game means little to them. Also, the fact that I am not profiting from the release makes a lot of difference. I am not about to write to Midway games and other arcade companies that may or may not even exist to gain permission to release logos and images downloaded from the web. I do understand that dispersing a model that I paid for for free could be the rub here as well. If anything, I have some great PU items for my game...lol I don't release anything here anyway, so you guys won't be in any danger. The agent did say he would pass on the question to a licensed agent to take a look at as well. I will not release anything until I hear back from them, but it appears I would be OK to do so. Well, as you both suspected, it doesn't look like I will be able to release the arcade games. Still talking to TurboSquid, however. Oddly, they don't seem to realize that people make downloads for games...lol. At least the guy I am talking to....lol. Will keep all updated. Keep an eye out here for more stuff coming soon! *EDIT* I could have released them if there was "central hub" of downloads that people couldn't access for their own. If you're taking suggesting Julio Lacereda is a must! Anyways the posters look nice and colourful, they'll be usefull in making nice guest areas. Any chance we can get bigger versions for use as murals? |
